Any dispute, controversy, or claim arising out of or relating to these Terms, including the formation, interpretation, breach, or termination thereof, including whether the claims asserted are arbitrable, will be referred to and finally determined by binding arbitration in accordance with the American Arbitration Association Rules.
The arbitration will be conducted by a single arbitrator, and the location of the arbitration shall be in Wyoming, United States, unless you and BankWise Academy agree otherwise. The language to be used in the arbitral proceedings shall be English.
The arbitrator will have exclusive authority to resolve any dispute relating to the interpretation, applicability, or enforceability of this binding arbitration agreement. The arbitrator shall be empowered to grant whatever relief would be available in a court under law or in equity.
You agree that any arbitration shall be conducted in your individual capacity only and not as a class action or other representative action, and you expressly waive your right to file a class action or seek relief on a class basis.
Notwithstanding the foregoing, you may bring an individual action in small claims court if your claim qualifies.
